Environmental Prosecutions

An increasing number of environmental prosecutions are being brought by the Environmental Agency, Local Authorities and other authorities in both the Magistrates and the Crown Court.

Prosecutions are being brought pursuant to the Environmental Protection Act 1990, the Control of Pollution Act 1974, the Water Resources Act 1991 and Environmental Act 1995.

The average fine for businesses which are prosecuted by the Environment Agency rose in 2000 to only 8,532 compared to 6,800 in 1999.
